1. Our Service Agreement

By requesting quotes, scheduling services, or engaging our commercial painting expertise, you agree to these terms.

Our goal is to provide transparent, professional painting services that exceed expectations while maintaining clear communication and mutual respect throughout every project.

3. Transparent Pricing

Project Estimates

Our quotes are detailed estimates based on current project specifications, material costs, and labor requirements. We provide comprehensive breakdowns including:

Estimate Adjustments

Pricing may be adjusted for legitimate business reasons:

Changes in project scope or specifications requested by client
Discovery of unforeseen conditions (water damage, structural issues)
Material price fluctuations beyond our control
Additional work discovered during project execution

Payment Structure

Project Deposit (50%):Required to secure scheduling and purchase materials
Progress Payments:For projects over $10,000, billed at key milestones
Final Payment:Due upon substantial completion and client approval
Payment Terms:Net 30 days from invoice date

4. Project Timeline and Scheduling

Project timelines are estimates and may be affected by various factors including weather conditions, material availability, unforeseen site conditions, and client-requested changes. We will make reasonable efforts to meet agreed-upon schedules.

Delays caused by circumstances beyond our control, including but not limited to acts of God, weather conditions, material shortages, or client delays, shall not constitute a breach of contract.

5. Client Responsibilities

As a client, you agree to:

Site Access and Preparation

Provide clear access to work areas and ensure proper site preparation before work begins.

Permits and Approvals

Obtain all necessary permits and approvals required for the project.

Communication

Provide timely decisions and approvals to maintain project schedule.

Utilities

Ensure utilities are available as needed for the work.

Protection of Property

Remove or protect valuable items from work areas.

6. Our Quality Guarantee

Professional workmanship you can trust

Workmanship Warranty - 2 Years

We're confident in our professional painting services. If defects in our workmanship appear within two years of project completion, we'll make it right at no additional cost to you.

What's Covered:

  • • Cracking, peeling, or blistering due to workmanship issues
  • • Poor adhesion or coverage problems
  • • Brush marks or roller patterns that weren't addressed
  • • Color matching discrepancies in multi-stage projects

Manufacturer Material Warranties

Premium paints and coatings come with manufacturer warranties that we help you navigate and enforce. These typically range from 5-15 years depending on the product and application.

We Help With:

  • • Documenting warranty claims and providing project records
  • • Coordinating with manufacturers for claim processing
  • • Recommending appropriate touch-up procedures
  • • Ensuring warranty compliance during repairs

Warranty Conditions & Exclusions

Warranties are designed to protect against defects in materials and workmanship, not normal building conditions or external factors.

Not covered: Settlement cracks, moisture intrusion, or structural movement
Not covered: Damage from accidents, abuse, or improper maintenance
Void if payment terms aren't met or modifications are made by others
Commercial properties may have different wear expectations than residential

7. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claims arising from or related to our services shall not exceed the total amount paid for the specific project in question.

We shall not be liable for consequential, incidental, special, or indirect damages, including but not limited to lost profits, business interruption, or property damage beyond the scope of our work.

8. Insurance and Safety

We maintain appropriate insurance coverage including general liability and workers' compensation insurance. Our employees follow strict safety protocols and comply with OSHA regulations.

We recommend that clients maintain appropriate insurance coverage for their property during construction projects.

9. Termination

Either party may terminate this agreement with written notice. In the event of termination:

Client Termination

Client shall pay for all work completed and materials purchased up to the termination date.

Company Termination

We may terminate if payment terms are not met or if unsafe working conditions exist.

10. Dispute Resolution

Any disputes arising from this agreement shall first be attempted to be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in Tarrant County, Texas, in accordance with the rules of the American Arbitration Association.

This agreement shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

11. Force Majeure

Neither party shall be liable for delays or failures in performance due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, strikes, government regulations, or material shortages.

12. Intellectual Property

All designs, specifications, and project documentation prepared by us remain our intellectual property unless otherwise agreed in writing. Client grants us permission to use project photos for marketing purposes unless specifically prohibited.

Client represents that they have all necessary rights to use any designs, trademarks, or materials provided to us.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes are posted constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with any written agreement or proposal, constitute the entire agreement between the parties and supersede all prior understandings, agreements, or representations.
